Buying a property in unequal shares?

If you are purchasing a property and would like to own the property in unequal shares then we can draft a Deed of Trust for you. It may be that one of you has put in a large deposit and wants to secure.

We will register the property for you as Tenants in Common, which means that should something happen to one of you your share is left under your Will and does not automatically pass to the co-owner.

You can at any time change to Tenants in Common and have a Deed of Trust drafted. For example, for inheritance tax purposes. If you do this you will also want to think about having a Will drafted or reviewing your Will at the same time.

The alternative to Tenants in Common is Joint Tenants; this means that you own the property jointly and if anything should happen to one of you the property automatically passes to the co-owner.
